Constitutional Court in Benin: the Opposition Protests Against the Four Designated Personalities

In Benin, the opposition challenges the four personalities appointed by the National Assembly to sit in the new Constitutional Court, on June 6th, for a five-year term. The Democratic party of former President Boni Yayi deplores that they all come from the Talon camp and demands the resumption of the appointment process.

Guy Mitokpe, a member of the “Les Démocrates” party, read a protest statement on Friday, May 26th, in Cotonou, to the press.

“The Democrats party would like to express its surprise and above all its astonishment at the method and approach used by the authorities”.

The office of the National Assembly is composed of the majority then of the parliamentary minority represented by the Democrats, the designation of the four personalities to the Constitutional Court cannot be done without a personality designated by the party “Les Démocrates”. While informing the national and international public opinion that its representative, in the office of the National Assembly, was not associated with the procedure of designation, it asks the office of the National Assembly to resume, in the forms and standards required by our positive law, the designation of personalities to sit in the next mandate of the Constitutional Court, taking into account the right of the parliamentary minority. Now they have to take it into account”.

The High Court, whose current members complete their term on June 5th, has seven wise men, four of whom are appointed by Parliament and three by the Head of State.
